Users under 18 years of age must have parental or guardian consent to use the Service. By allowing a minor to use the Service, parents and guardians agree to these Terms and accept responsibility for the minor's activity.

3. Premium Membership Terms

HandheldAlly offers optional Premium membership ("HandheldAlly+") with enhanced features and benefits. By subscribing, you agree to these additional terms.

Subscription Plans & Pricing:

Monthly Plan: $9.99 USD per month
Annual Plan: $99.99 USD per year (equivalent to $8.33/month - Save 17%)
Payment Processor: All payments are securely processed through Stripe, Inc.
Accepted Payment Methods: Credit/debit cards, Apple Pay, Google Pay, and other methods supported by Stripe

Billing & Auto-Renewal:

Billing Cycle: Subscriptions are billed in advance on a recurring monthly or annual basis
Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless cancelled
Price Changes: We will notify you at least 30 days before any price increase. Continuing your subscription after the notice period constitutes acceptance of the new price
Failed Payments: If payment fails, we'll retry according to Stripe's policies. Continued failure may result in subscription suspension

Cancellation Policy:

How to Cancel: Cancel anytime through your account settings or by contacting support@handheldally.com
Access After Cancellation: You retain Premium access until the end of your current billing period
No Partial Refunds: We do not provide refunds or credits for partial subscription periods
Reactivation: You can resubscribe at any time. Previous settings and data are retained for 90 days after cancellation

Refund Policy & EU Consumer Rights:

7-Day Money-Back Guarantee:

Beyond statutory rights, we offer all new subscribers a 7-day money-back guarantee from the date of first subscription. This applies only to first-time subscribers and not to renewals or reactivations.

EU 14-Day Withdrawal Right:

For consumers in the European Union, you have the right to withdraw from your subscription within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract.

To exercise your withdrawal right: Contact us at support@handheldally.com with your withdrawal request. We will reimburse all payments received from you without undue delay and no later than 14 days from the day we receive your withdrawal notice.

Important: If you request immediate access to Premium features during the withdrawal period, you acknowledge that you may lose your right to withdraw once the service has been fully performed. We will request your express consent and acknowledgment before granting immediate access.

Additional Terms:

Account Sharing: Premium subscriptions are for individual use only. Account sharing will result in termination
Feature Changes: We may add, modify, or remove Premium features with reasonable notice
Grandfathering: If we remove a feature you actively use, we'll offer alternatives or pro-rated refunds
Tax Responsibility: Prices exclude applicable taxes. You're responsible for any applicable taxes in your jurisdiction

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Be responsible for all activities under your account
Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Content Ownership & Licensing

⚠️ Important: Content Becomes Community Property

When you share content on HandheldAlly (including game settings, forum posts, comments, guides, and reviews), you grant HandheldAlly a perpetual, irrevocable, worldwide, royalty-free license to:

Use, reproduce, modify, adapt, publish, distribute, and display your content
Sublicense these rights to other users for community benefit
Use content for machine learning, AI training, and service improvements
Maintain content even after your account deletion

Content Persistence:

🚨 Critical Understanding: Shared content becomes part of the HandheldAlly community knowledge base and will remain available even if you:

•Delete your account
•Request content removal
•Terminate your subscription
•Violate our terms and are banned

Fair Exchange Principle:

By sharing content, you acknowledge it becomes community property for the benefit of all users.In exchange, you receive free access to our platform, validation services, community features, and optimization intelligence.

By submitting any content, you also:

Warrant that you own or have rights to the content
Agree that your content does not infringe on third-party rights
Accept responsibility for all content you submit
Understand that content will be subject to AI validation and community moderation

We reserve the right to remove content that violates these Terms, but removal does not affect our perpetual license to the content.

6. API Usage Terms

HandheldAlly may provide API access for developers and power users. By using our API, you agree to:

Rate Limits: Respect all rate limits (currently 100 requests per minute)
Attribution: Properly attribute HandheldAlly when using our data
Commercial Use: Commercial use requires written permission
No Scraping: Automated scraping of the website is prohibited
Security: Keep API keys secure and report any breaches immediately

We reserve the right to revoke API access for violations of these terms or abuse of the service.

7. Intellectual Property & Fair Use

HandheldAlly respects intellectual property rights. All game titles, logos, artwork, and related materials belong to their respective owners.

Game Content Fair Use Policy:

We use game images and information for informational and educational purposes only
Our use constitutes fair use under copyright law for criticism, comment, and teaching
We do not sell or profit directly from copyrighted game content
Game performance data and settings are user-generated and transformative in nature

The HandheldAlly platform, including its design, features, and original content, is owned by HandheldAlly and protected by intellectual property laws. Users retain ownership of their submitted content but grant us license to use it.

8. Prohibited Uses

You agree not to:

Violate any laws or regulations
Infringe on intellectual property rights
Submit false, misleading, or harmful content
Attempt to gain unauthorized access to the Service

Harass, abuse, or harm other users
Engage in commercial activities without authorization

9. User Safety & Reporting

10. Third-Party Services

HandheldAlly integrates with third-party services (such as Steam). Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services or content.

11. Account Termination

Termination by You:

You may terminate your account at any time through your account settings. Upon termination:

Your profile and content may be removed
Premium subscriptions will not be refunded for partial periods
Some anonymized data may be retained for legal purposes

Termination by HandheldAlly:

We may suspend or terminate accounts that:

Violate these Terms of Service
Engage in illegal activities or fraud
Harass or harm other users
Attempt to circumvent security measures

We will provide notice and opportunity to remedy violations when appropriate, except in cases of severe violations or illegal activity.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

We do not guarantee that game settings will work perfectly on all devices or configurations. Users apply settings at their own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDHELALLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify and hold harmless HandheldAlly, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution:

Before filing any legal action, you agree to try to resolve disputes informally by contacting us at legal@handheldally.com. We'll try to resolve disputes informally for 30 days.

Binding Arbitration:

If we cannot resolve a dispute informally, any disputes will be resolved through binding arbitration in accordance with the rules of the Czech Arbitration Court. The arbitration will be conducted in English.

Exceptions:

Small claims court actions
Intellectual property disputes
Violations of the Site's Terms of Use

16. Class Action Waiver

YOU AND HANDHELALLY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and HandheldAlly agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

17. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of the Czech Republic, subject to applicable EU regulations.

For EU Consumers: If you are a consumer residing in the European Union, mandatory consumer protection laws of your country of residence may also apply. These mandatory protections are in addition to the rights provided under these Terms and cannot be waived or limited by contract.

18. International Use

By accessing HandheldAlly from outside the Czech Republic, you agree to comply with all local laws and regulations regarding online conduct and content.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

The failure of HandheldAlly to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes.

21. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other legal notices published by us on the Service, constitute the entire agreement between you and HandheldAlly concerning your use of our Service.

These Terms supersede all prior agreements, understandings, and communications between you and HandheldAlly, whether written or oral, regarding the subject matter herein.
